1. Acceptance of Terms

By accessing or using MakePhotos (“the Service”), operated by MakePhotos (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MakePhotos is an AI-powered photo generation platform that allows users to upload images and generate new variations using artificial intelligence. Features and availability depend on your subscription plan.

3. Account Registration

  • You must sign in using a valid Google account.
  • You are responsible for all activity under your account.
  • You must be at least 18 years old to use the Service.
  • You agree to provide accurate and complete information.

4. Subscriptions and Payments

  • Paid plans are billed monthly or annually through Stripe.
  • AI credits are allocated per billing cycle and expire at the end of each period unless rollover is included in your plan.
  • Prices may change with 30 days' notice. Existing subscriptions are honored until renewal.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds are provided at our discretion. Partial-month refunds are not guaranteed.

5. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, abusive, or explicitly violent content.
  • Create non-consensual intimate imagery of real people.
  • Impersonate others or generate misleading content intended to deceive.
  • Violate any applicable law or third-party rights.
  • Attempt to reverse-engineer, exploit, or overload the Service.
  • Resell or redistribute access to the Service without authorization.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Content Ownership and Licensing

  • Your uploads: You retain ownership of images you upload to the Service.
  • Generated content: Subject to your plan's license terms, you own the images generated through the Service.
  • Commercial use: Commercial use of generated images is permitted only on Pro plans and above, as specified in your plan details.
  • Our license: You grant us a limited license to process your uploads solely to provide the Service.

7. AI-Generated Content Disclaimer

Content generated by AI may not always be accurate, appropriate, or free of defects. You are solely responsible for reviewing and using generated content. We do not guarantee that generated images will be free from resemblance to existing copyrighted works or real individuals.

8. Intellectual Property

The Service, including its design, code, AI models, branding, and documentation, is owned by MakePhotos and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law, MakePhotos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.
